These Terms of Service ("Terms") govern your use of the Drishti website, dashboard, and AI agent platform ("Service"). By creating an account or using the Service, you agree to these Terms.

1. Who We Are

2. The Service

Drishti provides an AI-powered sales and support agent that businesses ("Clients") deploy on their websites and communication channels to handle customer enquiries, capture leads, and book appointments.

3. Your Account

  • You must be at least 18 years old and able to enter a binding contract.
  • You are responsible for keeping your login credentials and API keys secure.
  • You are responsible for all activity under your account.
  • The information you give us must be accurate and kept up to date.

4. Trials, Plans, and Payment

  • New accounts may receive a free trial. Trial accounts that do not convert to a paid plan are deleted 30 days after the trial expires.

5. Your Responsibilities as a Client

You are the Data Fiduciary for your customers' data under the DPDP Act, 2023. You agree to:

  • Obtain all consents and give all notices required by law before your customers interact with your Drishti agent.
  • Provide accurate product, pricing, and policy information for your agent to use. You are responsible for the content you configure.
  • Review how your agent represents your business. AI responses can be wrong, and you are responsible for the commitments made in your business's name.
  • Not use Drishti for unlawful, deceptive, harassing, or harmful purposes.

6. Acceptable Use

You must not:

  • Reverse engineer, scrape, or attempt to extract the underlying models or source code.
  • Attempt to breach security, bypass rate limits, or access another Client's data.
  • Use the Service to send spam, to impersonate others, or to process data you have no right to process.
  • Resell the Service without our written permission.

We may suspend or terminate accounts that breach these Terms.

7. AI Output

Drishti uses AI language models. Responses are generated automatically and may be inaccurate, incomplete, or unsuitable for your situation. The Service is not a substitute for professional medical, legal, or financial advice. Where a conversation needs a human, you are responsible for setting up escalation and for following up.

8. Your Data and Our Rights

  • You keep ownership of the content and data you put into Drishti, including your conversations and leads.
  • You give us a limited licence to process that data only to provide the Service to you.
  • We own the Drishti platform, software, and branding.
  • Our handling of personal data is described in our Privacy Policy.

9. Availability

We aim for a reliable service but do not guarantee uninterrupted or error-free operation. We may modify the Service, and we will give reasonable notice of material changes where we can.

10. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is". Drishti is not liable for indirect or consequential losses, including lost profits or lost business opportunities. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.

11. Indemnity

You agree to indemnify Drishti against claims arising from your content, your breach of these Terms, or your breach of any law in using the Service.

12. Termination

You may stop using Drishti and close your account at any time. We may suspend or end your access if you breach these Terms or if required by law. Sections that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms. Material changes will be announced on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts of Muzaffarpur, Bihar.
